Definitions

Game Type is determined by the number of pictures on the game field. There are 3 types of games - - I type (2 pictures), II type (3 pictures) and III type (4 pictures).

Game Option is determined by the amount of mana/energy required to participate in the game. The game is divided into 5 ,,,, options - with 1, 5, 10, 50, and 250 mana/energy required to participate in each, respectively.

Game Mode is a combination of game type and game option. There are 15 game modes - I-1, I-5, I-10, I-50, I-250, II-1, II-5, II-10, II-50, II-250, III-1, III-5, III-10, III-50, and III-250.

Mana is a valuable in-game resource needed in order to participate in the games. mana Either mana or energy can be chosen, and mana is a resource used to pay for Augur Series tickets or to purchase energy.

Energy is a resource required to participate in the games in which Energy was the chosen resource. energy

Ticker is a line indicating the game the player has decided to participate in. It shows the game type (number of pictures), the game option, the table number, and the result.

Current Round is the round currently taking place that is determined by the server every minute.

Table is a randomly formed pool of players who play with the same resource type (either mana or energy) with the same game mode.

Minority picture is a picture which has been chosen by the minority of players.

General

Players must sign up to participate in the game.

The sign-up procedure requires the following data: email, nickname, password, and country.  After the registration you can upload a profile image (optional). The profile image and nickname should not contain offensive language, calls for violence, or propaganda relating to illegal activity. In case of violation of this regulation, the administrator may suspend or restrict the player's access to the game.

By registering in the game, the player confirms that he/she has read, understood, and accepted the Terms of Use, the Privacy Policy, the Cookies Policy, and the Refund Policy.

To significantly enhance the security of user accounts and offer a wide range of functionality, the administrator strongly recommends users to enable two-factor authentication, which can be found in “profile settings”.

It is possible to change the graphics settings of game. By clicking on the settings icon in the upper right corner, you can switch between different graphic modes and choose the settings that are most suitable for you.

A player is not allowed to have multiple accounts in the game.

It is forbidden in a game to collude with the other players in order to influence the game’s outcome. Any attempts to interrupt the functioning of the service, the support service, or chat are strictly prohibited.

In violation of the current rules, the administrator reserves the right (depending on the gravity of the violation) to warn the player and/or block his/her access to the game functionalities temporarily or forever.

Gameplay

The player can select one of two, three, or four pictures that appear on the game field. Victory in the game is a situation when the picture selected by the player was also selected by the minority of players at the end of the round. It is marked with an M sign. 

If there are several of such pictures, then all players who voted for these pictures become the winners of the game*.

*If there is a picture (pictures) that has (have) not received ANY vote, while the other pictures were chosen by MORE THAN ONE player each, and there is a SINGLE picture which has the Minority of votes, then the players who has chosen that picture receive their mana/energy back. But if there is MORE than 1 of such Minority picture, then all players lose the game and the mana lost by them is then transferred to the Minority Grail Treasure Fund and used for the formation of bonuses.

For example: 15 people chose between four pictures, and the result is as follows: 0, 2, 5, 8. Two players receive their mana/energy back, while the others lose.

For example: 15 people choose between four pictures, and the result is as follows: 0, 2, 2, 8. All players lose because they could not choose the least popular picture and there are MORE than 1 Minority picture.

Losing the game is marked with an “NT” (Next Time) icon. 

If there is a picture (pictures) that has not received any vote and a picture (pictures) that has received a vote from only one player, then that player becomes the winner. 

For example: 15 people chose between four pictures, and the result is as follows: 0, 1, 6, 8. In this case, the player who has chosen the second picture wins. Or, for example, if the result is as follows: 0, 1, 1, 13, then in this case there are two winners.

There are two main types of resources in the game - mana and energy.

By switching the mana and energy button, the player chooses the resource to be used in the game. 

The player then chooses the game mode to play in. There are three types of the games with 2, 3, or 4 pictures. There are also five game options — for 1, 5, 10, 50, and 250 mana or energy units for a round. Thus, there are 15 game modes.

A round lasts for 60 seconds. It starts regardless of the number of players who participate in the game. After 60 seconds, new images appear on the game field and a new round of the game begins. Each round has a number, which is the same for all game modes.

A round starts on all game modes at the same time; all intervals are determined by the general time of the server. Pictures on the tables of the same type are the same regardless of the game option and resource used.

With a sufficient amount of mana/energy, the player can combine several games, including games that have different modes. After choosing a game mode, the player can choose another and make a choice there, provided the player has enough resources to do so.

The picture is selected by clicking on it. Within a certain period of time (depending on the game type), the player can cancel or change his/her choice (therefore, refusing to participate in the game).  In case a player is participating in several games simultaneously, they can also cancel all selections in all games at once. 

If no picture was selected within a certain time (25 seconds for Type I games and 26 seconds for Type II and Type III games), the players’ access to the game will be closed and they will be unable to make a choice. The players will be asked to wait a few seconds until the next round begins.

Within the first 25 seconds of the game, the player can change his/her choice or cancel it, thus having refused to participate in the game. Once the first 25 seconds have passed, the player cannot abandon the game, however, they are permitted to change their choice within the next 11 seconds. After that (36 seconds after the start of the round), the player's choice is considered final and will be used when all of the players’ choices are counted for a specific picture on this table.

Within the first 26 seconds, a player can change his/her choice or cancel it, thus having refused to participate in the game. Once 26 seconds have passed, the player cannot refuse to participate in the game, but they can change their choice within the next 8 seconds. Then Statistics appears. The players have another 6 seconds to change their selection if they wish to do so. After this time (40 seconds after the start of the round), the player's choice is considered final and will be used when the votes of all players for specific pictures on the table are counted.

Within the first 26 seconds, a player can change his/her choice or cancel it, thus having refused to participate in the game. Once 26 seconds have passed, the player cannot refuse to participate in the game, but they can change their choice within the next 8 seconds. Then Statistics appears. The players have another 4 seconds to change their selection if they wish to do so. After that time has passed, the picture that was chosen by the most players at the 38th second from the start of the round will be removed and the players who chose this picture lose. However, if there are several of such pictures, then these players do not lose and remain in the game. The players have another 5 seconds to change their selection if they wish to do so. After this time (43 seconds after the start of the round), the player's choice is considered final and will be used when the votes of all players for specific pictures on the table are counted.

Distribution to tables

Once it becomes no longer possible to cancel the selection, all players playing in each particular mode are randomly divided into the tables. 

For example: 26 seconds after the start of the game in II-50 mode (3 pictures, 50 mana/energy units), the number of people who chose any picture made 500. These people will then be randomly divided into 12 tables. Each of the tables gets its own number. However, to prevent unfair game attempts, the table number is not shown to the player until 3 seconds are left in the procedure of determining the winners.

For counting the round results, only the selections of players sitting at the same table (as shown by the table number) will be counted. At one table, the player can select only one picture. If the player has several tickers of the same game mode, they will all be distributed to different tables and, if such a distribution is impossible, will be cancelled.

Once a table has been formed, a player can see the table of players he/she is playing with. Depending on the strategy, the player can use information about the rivals countries, level, their number, and consider previous player behavior that the player remembers from the previous games.

The minimum number of players to form a table:

For Type I games - 3; for Type II games - 5; for Type III games - 7. If the number of participants is smaller during the table formation, the player is notified that the table is not formed, and the amount of mana/energy spent to participate in the game is returned to the player. 

Mana/energy distribution in case of victory

The winners take mana/energy from each of the losers. The amount of mana/energy is equal to the game’s option number (1, 5, 10, 50, or 250) and distributed amongst the winners.

If several pictures on the same table received the minimum number of players' votes, then those players become the winners and the mana taken from the players who lost is shared amongst the winners (the players who voted for the pictures that won).

In the event that the game did not take place due to the lack of the minimum number of players required to form a table, and if all pictures got the equal number of players' votes, then the players neither lose nor receive any mana/energy.

Tickers and AutoPlay

When AutoPlay  is enabled, the picture in the chosen game mode will be selected automatically and randomly. At the beginning of each new round, the picture will be selected again until the player has enough resources to play in this mode.

The player can create multiple tickers  when playing in the same game mode. This can be done by pressing the “+” button after any of the pictures have already been selected by the player. The player's selection on the new ticker is the same as the selection made on the ticker when the “+” button was pressed. By switching between tickers, the player can change his/her choice and specifically set it for each particular case.

The player can cancel his/her selection and remove the ticker by pressing the “X”  or “-” button.  The “X” button removes the active ticker, while the “-” button removes the most recently created ticker. The “XX”  button can be used to remove all tickers at once. 

Breaking News & Top Strategists

The tables at which the players managed to win with the highest coefficients are displayed in the “Breaking News” line.

The “Top Strategists” line displays the players with the highest number of consecutive wins (throughout the course of the current day).

Profile

In their personal account  , a player can set up their account settings, enable/disable two-factor authentication, view statistics, game history, transaction history, and send gifts to other players. 

Two-factor authentication allows you to significantly enhance the security of your account. Despite the fact that two-factor authentication is not mandatory, the administrator strongly recommends players enable it. Additionally, without two-factor authentication, a player will not be able to send gifts to other players. 

An additional two-factor authentication code is sent in the following cases:

  • Log in to account (you can disable this feature with no need to disable the 2FA function entirely)

  • Changes to customer information (i.e. email, password)

  • Transfer of resources to another player (this function is available only if 2FA is enabled)


Minority Grail

Minority Grail is the highest game level and can be arranged only with mana. Mana is transferred to the Grail Prize Fund in the event that some pictures were not selected by any of the players, while all other pictures were selected by more than one player.

The Grail game is arranged for each of the 15 game modes and the prize fund of each game is formed by the mana given by the players in the games of this mode.

The player who has fulfilled certain conditions for a particular mode can participate in the Grail drawing.

For example: the next Grail drawing will be held in two days. If a player plays 150 games in I-1 mode (two pictures, 1 mana), then that player will get the right (ticket) to participate in the Grail drawing in I-1 mode. If the player once again meets this condition by the start of the game, he/she will receive another ticket. The number of possible tickets for one player in the same Grail game mode is limited to 50.

Any Grail game ticket is valid only for the next Grail game.

The Grail ticket enables the player to choose any number from 1 to 100 . If there are several tickets, each of them remains independent and the player can choose either the same or different numbers.

All numbers (from 1 to 100) that have been selected by at least one player will be taken into account during the Grail drawing. These numbers form a table, and the number that was chosen by the smallest number of players is declared the winning number. If there were several such numbers, then they are all considered the winning number and the entire Grail prize fund is divided amongst the players who have selected those numbers. The player can no longer change his/her choice after selecting a number.

If the player fulfills the participation conditions for the Grail drawing in any mode, the Player has the right to participate (receives a ticket) in all the drawings of the lower type and option. For example: if participation in the Grail drawing for Type II requires 50 mana, the player can participate in the raffle of the following drawing of the Grail option (II-50, II-10, II-5, II-1, I-50, I-10, I-5, and I-1). Similarly, having fulfilled the conditions for Grail III-250, the player is permitted to participate in all other Grail modes.

If the player, after having received a ticket, does not make any choice, the ticket expires after the Grail drawing.

A ticket to the Grail drawing can also be obtained without meeting the minimum requirements to receiving it as a bonus; it can be drawn by the players/community members.


Augur Series

Two Augur Series tournaments are held on game day (according to server time): Augur Series DayC:\Users\stani\Desktop\Скриншот 05-02-2020 133028.jpg (13:00) and Augur Series Night  (20:00). The tournaments take around two hours. The time and duration of the tournament may vary. It is not necessary to register at the tournament; the player who has a ticket at the moment of registration to the tournament will automatically become a participant.

Sale and the issuance of tickets for the Augur Series, as well as the possibility to transfer the tickets to other players, ends some time before the tournament starts, when registration closed.

You must have a ticket to this tournament (marked with the corresponding signs) to participate in the Augur C:\Users\stani\Desktop\Скриншот 05-02-2020 133028.jpg Series.

The ticket can be either purchased for the amount of mana specified in the tournament information (or on the market) or received as a bonus.

The prize fund of the tournament can be formed not only from mana received from the sale of tickets, but also supplemented with various bonuses.

A tournament table is formed from the players willing to participating in it.

The number of prize-winning places and the accompanying prizes depend on the number of tournament participants.

Tournaments may have restrictions for both the participants (their level, minimum and maximum number of participants, etc.) and for the games (for example: only Type II and III games, specific game options, etc.).

The key conditions of the tournament are as follows:

  • During the tournament, the player continues to play in normal mode with random players (not necessarily with other participants of the tournament); however, all games of the player in which he/she participates and which comply with the tournament conditions will be considered when the tournament table is drawn up. 

  • After each win in such games, the player’s win ratio is recorded in the rating table and summed up with the previous ratios. As a result, the higher the sum of the winning ratios (“Total X” column), the higher the player’s place in the ranking table.

  • Only the games in which mana was selected as a resource are taken into account

  • Loss does not affect the sum of the ratios

  • The game option does not affect the rating (only the final ratio does)

  • In case of the draw between several players, there is the following criteria priority which determines the winner: “TOTAL X” – Won/Games ratio – “Mana Earned”

Intelligence

During the course of playing the Minority, the player gains the experience, which is called Intelligence, thereby increasing his/her level in the game. There are 10 levels depending on the amount of gained experience

The color of the player's nickname also changes once the player achieves a new level, as shown in the table above.

The player's level affects both the quantity and quality of bonuses; the player of a higher level has a higher chance of gaining more mana/energy, as well as more valuable statistics, and other in-game features, such as bonuses. Since the number of bonus Augur Series tickets and Mantles is limited, they are distributed randomly between all active players.

The first 20 players who have reached the Mentalist level receive a lifelong  “Pro”   status, which increases the probability of receiving valuable bonuses by an additional 10%.

Intelligence points are given for participating in the game, as well as for execution of the other game and non-game actions.

Statistics

Throughout the course of the game, the player has the opportunity to receive some information about the current distribution of votes of the other players at specific points in time. This resource can be widely applied to various strategies, as it significantly influences the decision-making process of the players. 

Statistics (S)  is a game resource that allows players to see which one of the pictures, not counting the picture that the player himself chose, has received the minority of votes.

  • For example: 18 people chose between four pictures, and the distribution at the time the statistics appears is as follows: 3, 4, 5, 6. Then, the players who selected the first picture will see how many percent chose the second picture (since 4 is the smallest number among 4, 5, 6); those who chose the second picture will show how many percent chose the first picture (since 3 is the smallest number among 3, 5 and 6). Those who chose the third and fourth pictures will also be shown how many percent chose the first picture. **

** In case there are several such “Minority pictures”, one of them to show is chosen randomly. 

  • Statistics (S) shows the distribution of votes of only those players who sit at the same table with him/her. It can be used both for games in mana and energy resource modes. It is displayed within two seconds, from the 35th to the 37th second of the game. It shows the statistics at the moment of appearance (35th second). This Statistics is available only for certain types of tables. In addition, for each table type, only the statistics for this particular table type can be used. For example, S-4-10 statistics can only be used for games with four images and 10 mana/energy units. To use statistics, the player should: 

  1. Have statistics for this particular game mode

  2. Enable  the use of Statistics in the game by clicking on the corresponding button before tables are formed. 

The statistics will not be displayed at the above-mentioned time if these conditions are not met.

The player can get the statistics of different types as a bonus, purchase it at the marketplace, win it in tournaments, or receive it as a gift. The statistics received as a bonus are valid within 24 hours from the time of receipt, whereupon the bonus expires afterward. In addition, bonus statistics cannot be transferred to another player.

Bonuses

  1. This game features a sophisticated bonus system. The bonuses include a bonus for the daily first login, unique daily bonuses, holiday bonuses, bonuses for achieving various target actions, and more. The bonuses may include the following game features:
    • Statistics

    • Mana/Energy

    • Mantle of Intelligence

    • Mantle of the Deal Maker

    • Ticket to the Augur Series

    • Ticket to the Minority Grail

  2. Mantle of Intelligence allows the player to gain intelligence during the game at an increased rate (for example, with “X2” mantle, the player receives a double the amount of intelligence for the same action). It is valid for 24 hours from time of receipt. To take the advantage of this mantle, the player must first put it on by clicking on the corresponding icon. If the player receives additional Mantles of Intelligence (for example, as a bonus), each new Mantle of Intelligence Player put on, will replace the mantle that Player was previously wearing.

    Mantle of the Dealmaker заменитьenables the player to make any purchases in the game (except Mana, Specials and Tickets to the Augur Series) at a discount during the bonus duration. It is valid for 24 hours after the time of receipt. It cannot be transferred to another player. If the player receives additional Mantle of the Dealmaker (for example, as a bonus), each new Mantle of Dealmaker Player put on, will replace the mantle that Player was previously wearing.

    Ticket to the Augur Series confirms the player's right to participate in the Augur Series. A player can have only a single ticket for the same tournament. If the player receives additional tickets (for example, as a bonus) these tickets will be combined into one.

    Ticket to the Minority Grail   allows the player to participate in the Grail drawing without fulfilling the conditions for achieving the right to participate in it. It cannot be transferred to another player.

    Gift sending

    The player has the ability to transfer certain resources to other players. 

    For security reasons, the gifts can only be sent by those players who have enabled two-factor authentication for their accounts. Two-factor authentication does not affect the ability to receive gifts, however.

    The players can send the following items:

    • Mana (at least 5 units)

    • Statistics (except for statistics received as a bonus)

    • Mantle of Intelligence (if it was not wearing)

    • An Augur Series ticket (if the registration has not yet closed)

  3. The transferred items can be used by the receiving player immediately; there is no suspension period. However, a fee at the rate of 40% of the transferred mana is charged for the transfer of mana between players.

    Daily Missions

    For every new day (according to server time), the player receives a list of missions which will give the player pre-defined bonuses should they be fulfilled. The player has until the end of the day on which the missions were formed to successfully complete the mission (according to server time). If the player completes only a portion of these missions, the player will not receive the final bonuses.


Guild

Players can communicate in an open chat room, which can be accessed using the “Guild” button.

Additionally, the Guild window can be customized according to your personal preferences - you can transfer the Guild window, expand it, and narrow it. To do this, click on the red icon in the upper left corner of the Guild.

The following actions are strictly forbidden in the Guild:

  • Direct or indirect insults toward other chat participants

  • Using obscene language (even in a distorted form)

  • Discussing or addressing the issues of politics, race, religion, Nazism, suicide, as well as any illegal activity

  • Flooding, flaming, spamming, trolling, and  misusing caps lock

  • Promoting any websites, services, or products

  • Discussing the actions of chat moderators and administrators

  • Begging and seeking additional privileges from the administration

  • Taking any actions aimed at disrupting the chat and server operation

  • Publishing private correspondence between the player and the administrator

If a user violates any of the above-mentioned rules, his/her message can be deleted and the user may be blocked for any term considered reasonable by the administrator or moderator.

The player can contact the administrator using a special chat window. With this window, the player can asks questions, report an error or problem, or complain about actions of the chat moderators.

The Terms and Conditions and all other obligations and rules detailed in writing in Minority (collectively, the "Terms and Conditions") are by and between INTELLECTUAL GAMES OÜ, registration code 14753507, ("Minority," "INTELLECTUAL GAMES OÜ", “Services”, “Company”, "us," or "we") and everyone who uses Minority (each, "you," "user," or "player"). By using Minority, creating an account, and/or participating in any tournament or service offered on or in Minority, you accept and agree to be bound by all terms, conditions and notices contained or referenced in Minority, including the most current version of the Terms and Conditions. INTELLECTUAL GAMES OÜ may modify the Terms and Conditions at any time. Your continued use of Minority following such modifications signifies your acceptance of those modifications. You are responsible for reviewing the Terms and Conditions periodically in order to stay aware of such modifications.

Geographic Disclaimer. The Minority is administered by the INTELLECTUAL GAMES OÜ from Tallinn, Estonia and is intended for users around the world except specific regions.

Registration and participation in the games is open to all countries except Angola, Benin, Bostwana, Burkina Faso, Burundi, Cameroon, Cape Verde, Central African Republic, Chad, Comoros, Congo, Djibouti, Gabon, Gambia, Ghana, Guinea, Kenya, Liberia, Libya, Malawi, Mali, Mauritania, Mauritius, Morocco, Mozambique, Namibia, Niger, Nigeria, Rwanda, Senegal, Somalia, Sudan, Tanzania, Togo, Uganda, Zambia, Zimbabwe. Participants must be 18 years or older.

Failure of INTELLECTUAL GAMES OÜ to exercise their rights under these Terms and Conditions does not constitute a general waiver of those rights.

This Agreement and any documents referred to herein represent the entire agreement between INTELLECTUAL GAMES OÜ and you and supersede any prior agreement, understanding or arrangement, whether oral or in writing. We each acknowledge that we have not relied on any representation, undertaking or promise given by the other or implied from anything said or written in negotiations between us except as expressly stated in this Agreement.

For information purposes, ease of understanding and ease of access by the Player these Terms and Conditions may be published in several languages. Each and every version will contain the same principles however it is only the English version that shall govern the legal relationship between you and us. Should any form of discrepancy arise between the non-English and the English version of these Terms and Conditions, the English version shall prevail over the non-English version.

Any rights not expressly granted in these Terms and Conditions are reserved.

We reserve the right to request proof of age and identity of a Player, at any time, in order to prevent the access of the Website by minors. 

We reserve the right to seek all remedies available at law and in equity in respect of a breach of these Terms and Conditions.

You are not required to pay any entry fees.

By agreeing to these Terms and Conditions, you agree and declare that you have entered your own correct personal details, and that the source of all funds used on the Website are derived from legal activities and that you will not use the Website for illegal or fraudulent activity, including (and without limitation) money laundering as provided by the governing law that applies to You and/or any INTELLECTUAL GAMES OÜ company.

Severability

If any part of this Agreement is deemed invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that reflects as closely as possible the intent of the original provision and the remainder of this Agreement will continue to full effect.

Changes to Minority and/or Terms and Conditions

INTELLECTUAL GAMES OÜ reserves the rights to change, modify, update, discontinue, remove, revise, delete or otherwise change any portion of Minority or these Terms and Conditions, in whole or in part, at any time without further notice. If you access or use Minority in any way after the Terms and Conditions have been changed, you will be deemed to have read, understood and unconditionally consented to and agreed to such changes. The most current version of these Terms and Conditions will be available on https://minoritywins.com/rules/term and will supersede all previous versions of these Terms and Conditions.

ELIGIBILITY, OBLIGATIONS & PLAYER CONDUCT

Eligibility

To be eligible to register and open an account and/or participate in any tournament offered in Minority, you affirm that you: 

  • that you are of the age of 18 or any such other legal age or age or majority as determined by any laws applicable to you, whichever age is greater ("Legal Age");

  • own the email address submitted on your account registration form; 

  • are physically located in a jurisdiction in which participation in a game you select is unrestricted and not prohibited by law; 

  • at all times abide by the Terms and Conditions. 

  • that you are not conducting criminal or otherwise unlawful or unauthorized activities and/or intending to use your account opened with us in connection with such activities and that you shall not use or allow other persons to use the Website and your account for any criminal or otherwise unlawful activities including, without limitation, money laundering, under any law applicable to you or us;

  • not to use the Services/Website in any way which interferes or may interfere with the availability of the Services/Website to other users nor do anything that degrades or may degrade the operational performance of the Services and Website(s);

  • not to solicit or in any manner seek to obtain any information relating to other users;

You can use the Website solely for your private, non-commercial, personal use only. This does not give you any rights of ownership in the Website.

You agree not to use the Website in any way which is:

  • unlawful;

  • may give rise to civil or criminal liability for INTELLECTUAL GAMES OÜ; or

  • which might bring INTELLECTUAL GAMES OÜ into disrepute.

You shall not treat The Company as a financial institution.

Registration and Opening an account.

We will take reasonable and appropriate measures to ensure that your personal information as disclosed to us shall remain confidential and will be processed in accordance with our Privacy Policy as amended from time to time. We will not report or disclose your personal data except in accordance with our Privacy Policy. By entering any game you give your consent to us to publish your details on our Website in the event that you win any game.

You shall not: (i) select or use as a username a name of another person with the intent to impersonate that person; (ii) use as a username a name subject to any rights of a person other than you without appropriate authorization; or (iii) use, as a username, a name that is otherwise offensive, vulgar or obscene. You are solely responsible for the activity that occurs on your Account, and for keeping your Account password and login credentials secure. You may never use another person’s user Account or registration information for the without permission. You must notify us immediately of any change in your eligibility to use the Services (including any changes to or revocation of any licenses from state authorities), breach of security or unauthorized use of your Account. You should never publish, distribute or post login information for your Account. 

You may log in to use the Services by using your Facebook account. By using your Facebook account to log in to the Services, you affirmatively consent to our sharing of your actions and data with Facebook. You must have a valid, active Facebook account to use and access the Services.

You may need to update third-party software, such as your operating system, from time to time to access the Services. We are not responsible in any way for such third-party software. You are responsible for the device you use to access the Services and the fees to connect to the Internet and application marketplaces or for data or cellular usage to download and use the Services.

The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. We do not knowingly collect or solicit personally identifiable information from children under 13; if you are a child under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us personal information, please contact us at admin@minoritywins.com.

Location of Users
You are subject to all laws of the city, state, province and country in which you reside and from which you access Minority. You are solely responsible for complying with those laws. Access to Minority may not be legal for some or all residents in certain jurisdictions. You agree that INTELLECTUAL GAMES OÜ cannot be held liable if laws applicable to you restrict or prohibit your use of or participation with Minority. INTELLECTUAL GAMES OÜ makes no representations or warranties, express or implied, as to the lawfulness of your accessing Minority or participating in any tournament offered in Minority. No person affiliated, or claiming affiliation, with Minority has authority to make any such representations or warranties.

INTELLECTUAL GAMES OÜ reserves the right (but has no obligation to you) to monitor the location from which you access Minority and to block access from any jurisdiction in which participation or access may be illegal or restricted. INTELLECTUAL GAMES OÜ may block access to players using proxy servers or any other method which is intentionally used in order to conceal a player's true location. INTELLECTUAL GAMES OÜ may further block players if you are in a jurisdiction where INTELLECTUAL GAMES OÜ is unable to accurately verify your location. We may require any participant receiving any prize to provide us with proof that you are, or at the time the subject tournament was played, eligible to participate according to the Terms and Conditions. If we monitor your access or participation with Minority, we shall not be liable for the effectiveness of such monitoring. By accessing, using, downloading in any way any materials in Minority browsing Minority, creating an account and/or participating in any tournament or service offered by or through Minority, you represent and warrant that you are doing so in compliance with the Terms and Conditions and agree to indemnify and hold harmless INTELLECTUAL GAMES OÜ from any liability, claims, and damages (including attorneys' fees) arising out of or related to your violation of these Terms and Conditions.

If you open an account and/or participate in any tournament offered in Minority while located in a prohibited jurisdiction, you may be in violation of the law of such jurisdiction and will be in violation of the Terms and Conditions and subject to having your account suspended or terminated. In addition, and without limiting any rights or remedies available to Us, in the event of any violation of the Terms and Conditions, all winnings, Game resources may be voided, and in the event such winnings have already been received by you, recouped by Us, at our sole and absolute discretion.

Recommended Devices, System Requirements and Configuration

You understand that by participating in games or any tournaments in Minority, you may be playing against other players using different types of devices. INTELLECTUAL GAMES OÜ shall not be liable for damage that occurs or issues you may encounter if your device does not meet the minimum system requirements or as a result of playing against user of different types of devices.

INTELLECTUAL GAMES OÜ shall not be held liable for damage that occurs or issues that are encountered if your device does not meet the minimum system requirements.

You accept that you are solely responsible for the supply and maintenance of all of the computer equipment and telecommunications networks and internet access services that you need to use in order to access minoritywins.com (“Website”). We will not be liable in any way whatsoever for any loss caused to you by the internet or any telecommunication service provider which you have engaged in order to access to the Services or to the Website.

You accept that if your browser loses connection with our servers at any point during the game you will be eliminated from the game as soon as new round starts.  This might include, but not be limited to, loss of internet connection, changing the page on the browser and closing the browser window or tab.

Acknowledgment of Proprietary Rights
By registering for an account and/or participating in any tournament offered on Minority, you acknowledge that all information contained in Minority may be protected by one or more valid copyrights, patents, trademarks, trade secrets, or other proprietary rights, and that all such rights are owned by INTELLECTUAL GAMES OÜ. INTELLECTUAL GAMES OÜ neither warrants nor represents that your use of materials displayed in Minority will not infringe rights of third parties. INTELLECTUAL GAMES OÜ assumes no liability or responsibility for any errors or omissions in the content of Minority.

Any communication or material you transmit to INTELLECTUAL GAMES OÜ by electronic mail or otherwise, including any data, questions, comments, suggestions, etc. will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by INTELLECTUAL GAMES OÜ or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast, Minority promotion, marketing and posting. INTELLECTUAL GAMES OÜ is free to use any ideas, concepts, know-how or techniques contained in any communication you send to INTELLECTUAL GAMES OÜ for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information, without any additional compensation or other liability or obligation to you.

The trademarks, logos, and service marks (collectively the "Trademarks") displayed in Minority, are registered and unregistered Trademarks of INTELLECTUAL GAMES OÜ's and/or others. Nothing contained in Minority should be construed as granting any license or right to use any Trademark displayed on the Site without the written permission of INTELLECTUAL GAMES OÜ or such third party that owns the Trademark. Your misuse of any Trademark displayed in Minority, except as provided in the Terms and Conditions, is strictly prohibited.

Except for these terms and conditions, you may not in any way or by any means adapt, copy, modify, reproduce, store, distribute, display, publicly perform, publish, transmit, sell, rent, lease or license without our express prior written consent.

User Content. All Content added, created, uploaded, submitted, distributed, or posted to the Services by users (collectively "User Content"), whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such User Content. 

License Grant. By submitting User Content through the Services, you hereby do and shall grant us a worldwide, non-exclusive, perpetual, royalty-free, fully paid, sublicensable and transferable license to use, edit, modify, manipulate, truncate, aggregate, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User Content in connection with the App, the Services and our (and our successors’ and assigns’) businesses, including without limitation for promoting and redistributing part or all of the App or the Services (and derivative works thereof) in any media formats and through any media channels (including, without limitation, third party websites and feeds), and including after your termination of your Account or the Services. For the sake of clarity, to the extent any User Content you submit includes your name, likeness, voice, video, or photograph, you acknowledge and agree that the foregoing license shall apply to the same. Winner photographs may be used in promotional activities such as print and online advertising campaigns.

You also hereby do and shall grant each user of the App and/or the Services a non-exclusive, perpetual license to access your User Content through the App and/or the Services, and to use, edit, modify, reproduce, distribute, prepare derivative works of, display and perform such User Content, including after your termination of your Account or the Services. For clarity, the foregoing license granted to us and our users does not affect your other ownership or license rights in your User Content, including the right to grant additional licenses to your User Content, unless otherwise agreed in writing. You represent and warrant that you have all rights to grant such licenses to us without infringement or violation of any third party rights, including without limitation, any privacy rights, publicity rights, copyrights, trademarks, contract rights, or any other intellectual property or proprietary rights.

All third party trade names and trademarks are the property of their respective owners and we make no warranty or representation in relation to them.

You acknowledge that we are not responsible for any User Content posted in connection any portion of the Services.

If you are aware of any User Content posted in connection with the Services that violates these Terms of Use, please contact us at LEGAL@MINORITYWINS.COM. Please provide as much detail as possible, including a copy of the underlying material, the location where we may find it, and the reason such User Content should be removed. Please note that filing a complaint will not guarantee its removal. We only will remove User Content if we believe the measure is necessary, in our sole discretion.

Promotional Activities
By registering for an account, you agree that INTELLECTUAL GAMES OÜ may display your username and tournament records. By accepting any prize from INTELLECTUAL GAMES OÜ, you agree to allow INTELLECTUAL GAMES OÜ to print, publish, broadcast and use, worldwide, in any media and at any time, your name, picture, voice, likeness, and/or biographical information for promotional, marketing or related purposes without additional compensation.

ACCOUNT MANAGEMENT

Limitations on Number of Accounts

You may establish only one account per person to participate in the activities offered on Minority. Multiple accounts may not be created sharing the same name or email. INTELLECTUAL GAMES OÜ reserves the right to monitor all activities on Minority, including any effort to establish multiple accounts. In the event INTELLECTUAL GAMES OÜ discovers that you have violated the number of accounts allowed, all additional accounts will be closed without notice and continued violation may result in the termination of any and all of your accounts and INTELLECTUAL GAMES OÜ may void any associated winnings, Game Resources of any or all of the account(s). INTELLECTUAL GAMES OÜ further reserves the right to deny access to anyone, including, but not limited to, those players who use proxy servers and/or IP addresses residing in certain geographical areas. Your account may be blocked in case of logging in Account into multiple devices simultaneously.

Credit Card Transactions, Game Resources and Deposit Resources

You agree that we or a payment processing company on our behalf will handle all financial account transactions ("Payment Processor"). You hereby agree that the Payment Processor reserves the right to withhold any payments should the Payment Processor have reason to believe or any suspicion that you may be engaging in or have engaged in fraudulent, collusion, unlawful, or improper activity.

INTELLECTUAL GAMES OÜ reserves the right to set expiration dates or other limits on all Game Resources. Game Resources are defined as any credit to play a game deposited by INTELLECTUAL GAMES OÜ into an account, including, but not limited to, promotional Resources, prize Resources and gift Resources. Deposit Resources are defined as any credit to play a game deposited into an account for making a purchase in store located at https://minoritywins.com/shop/. INTELLECTUAL GAMES OÜ may void the Game Resources balances of any dormant account. A dormant account is an account that has been inactive for greater than four (4) months.

Once payment towards the Minority has been submitted, the payment may not be cancelled, revoked or changed.

You are fully responsible for paying all monies owed to us. In respect of any payment made by you, you agree that you will not make or procure the making of any charge-backs and/or deny or reverse any such payment, and that you will reimburse us for any charge-backs, denials or reversal of payments you make, and any and all losses suffered and expenses incurred by us as a consequence. We may, at our sole and absolute discretion, cease to provide services or payment to certain users or to users paying with certain credit or debit cards.

If You have a query with regard to any transaction, You may also contact Us with details of the query. We will review any queried or disputed transactions. Our judgment is final.

Fraud and Abuse

Fraud and abuse relating to the access and use of Minority is strictly prohibited. In accessing Minority or participating in any activities, products or services offered by or through Minority, you represent and warrant that: (a) all information you supply is complete and accurate and not in violation of any applicable laws, regulations or these Terms and Conditions; and (b) you will not circumvent or attempt to circumvent any provision of the Terms and Conditions or engage in any activity that interrupts or attempts to interrupt the operation of Minority. Users engaging, participating or displaying behavior that may be interpreted, in INTELLECTUAL GAMES OÜ's sole and absolute discretion, as the use of unfair methods in Minority, including but not limited to:

(i) the opening and/or use of multiple accounts;

(ii) the use of unauthorized or altered software or hardware to assist play (including the use of bots, bot nets, jail broken devices or rooted devices, collusion with bots and/or use of cheat programs such as debuggers, clock-skewing software and memory scanners);

(iv) collusion with other players;

(vi) harassment of other participants;

(vii) posting of objectionable material;

(viii) any breach of the Terms and Conditions;

(ix) any breach of the security of your account or Minority; or

(x) any other act (whether through the use of automated technology or otherwise) that unfairly alters your chance of winning or constitutes the commission of fraud (collectively, "Abuse")

Engaging in any of the above or any similar behavior, while playing Minority, may subject you to immediate consequences (as determined by INTELLECTUAL GAMES OÜ in its sole and absolute discretion), including without limitation: (1) immediate termination of your account and blocking of Minority access; (2) forfeiture of any prizes, winnings, Game Resources and any other item of value (if any) that you may otherwise have been entitled to receive; (3) disgorgement and/or recoupment of any prizes, winnings, Game Resources and other items of value already received by you; and (4) in the case suspected illegal activity, disclosure to law enforcement agencies in accordance with federal and state laws. In the investigation of an alleged Abuse, INTELLECTUAL GAMES OÜ may request additional information from you. You agree to provide all reasonable and relevant information as requested by INTELLECTUAL GAMES OÜ. Without limiting any provision of the Terms and Conditions, INTELLECTUAL GAMES OÜ expressly reserves the right to institute or seek any injunctive relief, civil and/or criminal proceedings against you and/or any of your co-conspirators arising out of or related to your commission of Abuse, including the right to recover fees and expenses (including attorneys' fees) and the right to report you and such Abuse to any and all relevant regulatory authorities or governmental agencies.

INTELLECTUAL GAMES OÜ does not warrant that user submitted content is verifiable, nor does INTELLECTUAL GAMES OÜ warrant that user submitted details such as age, location etc are truthful. INTELLECTUAL GAMES OÜ is not responsible for any interaction between players on the site.

In compliance with applicable laws, court orders and lawful government and regulatory requests we may be required to access and disclose individually identifiable information on registered members.

You are not permitted to translate, reverse engineer, decompile, disassemble, modify, create derivative works based on, or otherwise modify the quiz application software.

You are not permitted to bypass the security system or interfere in any way with the Services or the Website or attempt to make any changes to the Software and/or any features or components.



Withdrawal Requests

Game Resources have no cash value and cannot be withdrawn. User's failing to comply with an investigation of or Users found to have engaged in Abuse, may have their winnings voided.

If your account is closed by INTELLECTUAL GAMES OÜ for a violation of the Terms and Conditions, your winnings and any Game Resources may be voided and not returned to you. 

Account Cancellation

You may cancel your account by contacting INTELLECTUAL GAMES OÜ at admin@minoritywins.com

Your account is not considered cancelled until you have received confirmation of such cancellation from INTELLECTUAL GAMES OÜ. You may not cancel your account to evade an investigation. If you do not agree to the terms of the INTELLECTUAL GAMES OÜ Policies, your sole remedy is to not use Minority and to cancel your account.

Upon the termination of this Agreement for whatever reason, the License issued under this Agreement is automatically revoked and you shall stop using the quiz application/services.

Should this not be possible, then the remaining balance in that Account will be removed at the end of this further period of 1 year in total from becoming Dormant and the Account closed.

TOURNAMENTS

Game Rules
Rules for each specific game offered in Minority can be found within the Tutorial and Game Rules for each game.

We reserve the right at any time to cancel, modify or replace the prize draw (including varying the prizes) if, at our sole discretion, a prize draw is not capable of being conducted as specified.

You acknowledge that in the unlikely event of a disagreement between any result that appears on the Website and our server, the result that appears on the server will prevail and you acknowledge and agree that our records will be the final authority in determining the terms and circumstances of your participation in the gaming activity.

If you have any dispute with regard to the result or of any game, play or event with regards but not limited to: the result, rulings and treatment applied by us, technical or other disruption, etc, you must submit your written complaint to us, via email, within fourteen (14) days from the date of the result of any game or event.

In the event of any dispute regarding winnings, our decision will be final and binding. 

Unless otherwise stated, in case of conflict between these Terms and Conditions and any other document referred to in these Terms and Conditions, these Terms and Conditions will prevail;

It is strictly prohibited to:

  • Exploit or distribute any game error or technical glitch that provides an unintended advantage to a user, including but not limited to accessing one time promotions more than once;

  • Fraudulently acquire Virtual Currency or Virtual Goods;

  • Rent, lease, sell, trade, or otherwise transfer or share your account to or with anyone without INTELLECTUAL GAMES OÜ 's written permission;

  • Access or use an account which has been rented, leased, sold, traded, or otherwise transferred from the account creator without INTELLECTUAL GAMES OÜ written permission;

You shall immediately inform the Company of the error and shall repay any winnings credited to Your Player Account in error to The Company (as directed by The Company) or The Company may, at its discretion, deduct an amount equal to those winnings from Your Player Account.

If prior to The Company becoming aware of the error You have played with funds that do not belong to You, without prejudice to other remedies and actions that may be available at law, the mistakenly paid winnings will be deducted. In the event of an incorrect crediting, You are obliged to notify The Company immediately by email admin@minoritywins.com.

We reserve the right to offer, from time to time, bonuses and/or promotions and special offers and that any such offer will be subject to its own rules and conditions. We reserve the right to withdraw any of these special offers and bonuses at any time.

LIMITATION OF LIABILITY

Unauthorized Charges

INTELLECTUAL GAMES OÜ is not liable for any loss caused by any unauthorized use of your credit card or other method of payment by a third party in connection with Minority. If you wish to dispute a charge to your account, you must do so within 14 days of the alleged unauthorized charge(s) otherwise such a dispute will be deemed waived by INTELLECTUAL GAMES OÜ. Upon notification of a disputed charge, INTELLECTUAL GAMES OÜ may conduct an investigation to determine the amount, if any, considered unauthorized.

Attempts to defraud INTELLECTUAL GAMES OÜ through the use of credit cards or other methods of payment, or your failure to honor legitimate charges or requests for payments may result in immediate termination of your account, forfeiture of prizes and/or civil and/or criminal prosecution.

Hacking, Tampering, or Unauthorized Access
IN NO EVENT SHALL WE, NOR OUR DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO THE SERVICES FOR ANY injuries, death, loss, tax liability or damage of any kind ,LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, COMPENSATORY OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (HOWEVER ARISING), FOR ANY BUGS, VIRUSES, TROJAN HORSES.

By using the Minority, each Player further agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with Player’s use the Minority game resources earned or Prizes awarded, shall be resolved individually without resort to any form of class action.

You are responsible for the security of your account. If you give someone access to your account and they conduct a transaction without your knowledge or permission, you are responsible for any resulting use. Such transaction is not considered to be unauthorized by INTELLECTUAL GAMES OÜ.

Any attempt to gain unauthorized access to INTELLECTUAL GAMES OÜ's systems or any account, interfere with procedures or performance of Minority, or deliberately causing damage to or undermining Minority, may subject you to civil and/or criminal prosecution and may result in immediate termination of your account and forfeiture of any prizes.

You shall not: (i) take any action that imposes or may impose (as determined by us in our sole discretion) an unreasonable or disproportionately large load on our (or our third party providers’) infrastructure; (ii) interfere or attempt to interfere with the proper working of the Services or any activities conducted on the Services; (iii) bypass, circumvent or attempt to bypass or circumvent any measures we may use to prevent or restrict access to the Services (or other accounts, computer systems or networks connected to the Services); (iv) run any form of auto-responder or "spam" on the Services; (v) use manual or automated software, devices, or other processes to “crawl” or “spider” any page of the Minority without our express written permission; (vi) harvest or scrape any Content from the Services; or (vii) otherwise take any action in violation of our guidelines and policies.

You will not create or provide any means (including, without limitation, via emulators) through which the Software may be used by others.

In the event of systems or communications errors relating to account settlement or any other elements of the Service, we will not be liable to you as a result of any such errors and we reserve the right to void all plays affected by such error, interference or damage and take any action to correct such errors, damage to your own computer system, any other Device(s) or data contained within.

We, our affiliates, partners, officers, employees and agents shall in no event be responsible or liable for any damages, loss or expense, including without limitation direct, indirect, consequential or special damage or economic loss arising from or in connection with your access or use of the Services, Website(s), Software and the Information.

Accounts for Individual Use Only
You are solely responsible for all obligations relating to your account and for compliance with these Terms and Conditions. You are entitled to all benefits accruing to you as a result of being the account holder. You may not allow any other person to access your account, access Minority, accept any winnings, or participate in any Tournament using your account. Your account is not transferable. By registering and/or participating in any Tournament offered in Minority, you agree to indemnify, defend, and hold INTELLECTUAL GAMES OÜ harmless from or for any claims, liability, damages, and/or costs (including attorneys' fees) arising from any use of your account by any person.

Minority and Account Availability

INTELLECTUAL GAMES OÜ does not guarantee that Minority or access to your account will be available at all times and/or in all geographic locations. INTELLECTUAL GAMES OÜ is not liable for any loss which may be caused by your inability to access Minority or your account.

We will not be liable for any loss to you or a third party as a result of:

MERCHANDISE PRIZES

General Disclaimer
Terms and Conditions for tournaments with merchandise prizes are the same as those for ordinary games (for mana or energy as Virtual Currency).

Substitution
Players may request from INTELLECTUAL GAMES OÜ an offer of cash payment in lieu of any prize won, although INTELLECTUAL GAMES OÜ is under no obligation to grant such request. If INTELLECTUAL GAMES OÜ elects, in its sole discretion, to offer a cash payment in lieu of any prize won, INTELLECTUAL GAMES OÜ reserves the right to determine the exact amount of the cash offer, even if such cash offer may be less than the value of the prize. The player may then elect to accept INTELLECTUAL GAMES OÜ's cash offer, accept the original prize, or decline both and take nothing. INTELLECTUAL GAMES OÜ also reserves the right to credit the account of a merchandise prize winner with mana (the amount of which is in INTELLECTUAL GAMES OÜ's sole discretion) in the event the prize remains unclaimed for a certain period of time which shall in no event be less than thirty (30) days

Ties
In the event of a tie in a merchandise prize Augur Series, the player who posted the tying score first will be considered to have finished ahead of the other tying player(s). For example, if user X and user Y tie for 1st place with a score of 1500, and user X finished his/her game at 2:00pm, and user Y finished his/her game at 3:00pm, user X would win the 1st place prize, and user Y would win the 2nd place prize (if any).

Taxes
As with our Augur Series, users are responsible for applicable income taxes for merchandise prizes. Either the Manufacturer's Suggested Retail Price, or INTELLECTUAL GAMES OÜ's acquisition price, at INTELLECTUAL GAMES OÜ's discretion, will be used as the cash value of the merchandise prize.

Warranties
In the case of merchandise covered by a manufacturer's warranty, the manufacturer and not INTELLECTUAL GAMES OÜ is responsible for initial defects, subsequent use or misuse or covered repairs. In the case of merchandise not covered by a manufacturer's warranty, the merchandise is offered "as is", and INTELLECTUAL GAMES OÜ is not responsible for any defects, use or misuse or repairs. INTELLECTUAL GAMES OÜ makes no representations or warranties with respect to the authenticity or genuineness of any merchandise prizes, particularly collectible prizes.

Force Majeure

CUSTOMER COMPLAINTS AND DISPUTES

Player complaints are taken seriously at Minority.

If you have a complaint or are experiencing difficulty with the Services you can raise your complaint with the Customer Support team either via email customer@minoritywins.com or Chat with Administration.

Any complaint or claims of any nature, including with regard to the Player Account (gameplay, transactions or other matters) or Player Account balance, should be communicated to us as soon as possible by contacting our Customer Support team and no later than 14 days after the issue has occurred.

Intellectual Games OÜ commits to respond to the complainants with the results of the inquiry within one month from the date of the lodgement of the complaint, and will endeavour to provide a prompt resolution of issues at hand.

Virtual Currency
The Services may include a virtual, in-game currency ("Virtual Currency") including, but not limited to mana or energy, that may be purchased through the Services for "real world" money if you are legally permitted to purchase such Virtual Currency in your country, province, jurisdiction and/or state of residence. Definitions

Game Type is determined by the number of pictures on the game field. There are 3 types of games - - I type (2 pictures), II type (3 pictures) and III type (4 pictures).

Game Option is determined by the amount of mana/energy required to participate in the game. The game is divided into 5 ,,,, options - with 1, 5, 10, 50, and 250 mana/energy required to participate in each, respectively.

Game Mode is a combination of game type and game option. There are 15 game modes - I-1, I-5, I-10, I-50, I-250, II-1, II-5, II-10, II-50, II-250, III-1, III-5, III-10, III-50, and III-250.

Mana is a valuable in-game resource needed in order to participate in the games. mana Either mana or energy can be chosen, and mana is a resource used to pay for Augur Series tickets or to purchase energy.

Energy is a resource required to participate in the games in which Energy was the chosen resource. energy

Ticker is a line indicating the game the player has decided to participate in. It shows the game type (number of pictures), the game option, the table number, and the result.

Current Round is the round currently taking place that is determined by the server every minute.

Table is a randomly formed pool of players who play with the same resource type (either mana or energy) with the same game mode.

Minority picture is a picture which has been chosen by the minority of players.

General

Players must sign up to participate in the game.

The sign-up procedure requires the following data: email, nickname, password, and country.  After the registration you can upload a profile image (optional). The profile image and nickname should not contain offensive language, calls for violence, or propaganda relating to illegal activity. In case of violation of this regulation, the administrator may suspend or restrict the player's access to the game.

By registering in the game, the player confirms that he/she has read, understood, and accepted the Terms of Use, the Privacy Policy, the Cookies Policy, and the Refund Policy.

To significantly enhance the security of user accounts and offer a wide range of functionality, the administrator strongly recommends users to enable two-factor authentication, which can be found in “profile settings”.

It is possible to change the graphics settings of game. By clicking on the settings icon in the upper right corner, you can switch between different graphic modes and choose the settings that are most suitable for you.

A player is not allowed to have multiple accounts in the game.

It is forbidden in a game to collude with the other players in order to influence the game’s outcome. Any attempts to interrupt the functioning of the service, the support service, or chat are strictly prohibited.

In violation of the current rules, the administrator reserves the right (depending on the gravity of the violation) to warn the player and/or block his/her access to the game functionalities temporarily or forever.

Gameplay

The player can select one of two, three, or four pictures that appear on the game field. Victory in the game is a situation when the picture selected by the player was also selected by the minority of players at the end of the round. It is marked with an M sign. 

If there are several of such pictures, then all players who voted for these pictures become the winners of the game*.

*If there is a picture (pictures) that has (have) not received ANY vote, while the other pictures were chosen by MORE THAN ONE player each, and there is a SINGLE picture which has the Minority of votes, then the players who has chosen that picture receive their mana/energy back. But if there is MORE than 1 of such Minority picture, then all players lose the game and the mana lost by them is then transferred to the Minority Grail Treasure Fund and used for the formation of bonuses.

For example: 15 people chose between four pictures, and the result is as follows: 0, 2, 5, 8. Two players receive their mana/energy back, while the others lose.

For example: 15 people choose between four pictures, and the result is as follows: 0, 2, 2, 8. All players lose because they could not choose the least popular picture and there are MORE than 1 Minority picture.

Losing the game is marked with an “NT” (Next Time) icon. 

If there is a picture (pictures) that has not received any vote and a picture (pictures) that has received a vote from only one player, then that player becomes the winner. 

For example: 15 people chose between four pictures, and the result is as follows: 0, 1, 6, 8. In this case, the player who has chosen the second picture wins. Or, for example, if the result is as follows: 0, 1, 1, 13, then in this case there are two winners.

There are two main types of resources in the game - mana and energy.

By switching the mana and energy button, the player chooses the resource to be used in the game. 

The player then chooses the game mode to play in. There are three types of the games with 2, 3, or 4 pictures. There are also five game options — for 1, 5, 10, 50, and 250 mana or energy units for a round. Thus, there are 15 game modes.

A round lasts for 60 seconds. It starts regardless of the number of players who participate in the game. After 60 seconds, new images appear on the game field and a new round of the game begins. Each round has a number, which is the same for all game modes.

A round starts on all game modes at the same time; all intervals are determined by the general time of the server. Pictures on the tables of the same type are the same regardless of the game option and resource used.

With a sufficient amount of mana/energy, the player can combine several games, including games that have different modes. After choosing a game mode, the player can choose another and make a choice there, provided the player has enough resources to do so.

The picture is selected by clicking on it. Within a certain period of time (depending on the game type), the player can cancel or change his/her choice (therefore, refusing to participate in the game).  In case a player is participating in several games simultaneously, they can also cancel all selections in all games at once. 

If no picture was selected within a certain time (25 seconds for Type I games and 26 seconds for Type II and Type III games), the players’ access to the game will be closed and they will be unable to make a choice. The players will be asked to wait a few seconds until the next round begins.

Within the first 25 seconds of the game, the player can change his/her choice or cancel it, thus having refused to participate in the game. Once the first 25 seconds have passed, the player cannot abandon the game, however, they are permitted to change their choice within the next 11 seconds. After that (36 seconds after the start of the round), the player's choice is considered final and will be used when all of the players’ choices are counted for a specific picture on this table.

Within the first 26 seconds, a player can change his/her choice or cancel it, thus having refused to participate in the game. Once 26 seconds have passed, the player cannot refuse to participate in the game, but they can change their choice within the next 8 seconds. Then Statistics appears. The players have another 4 seconds to change their selection if they wish to do so. After that time has passed, the picture that was chosen by the most players at the 38th second from the start of the round will be removed and the players who chose this picture lose. However, if there are several of such pictures, then these players do not lose and remain in the game. The players have another 5 seconds to change their selection if they wish to do so. After this time (43 seconds after the start of the round), the player's choice is considered final and will be used when the votes of all players for specific pictures on the table are counted.

Distribution to tables

Once it becomes no longer possible to cancel the selection, all players playing in each particular mode are randomly divided into the tables. 

For example: 26 seconds after the start of the game in II-50 mode (3 pictures, 50 mana/energy units), the number of people who chose any picture made 500. These people will then be randomly divided into 12 tables. Each of the tables gets its own number. However, to prevent unfair game attempts, the table number is not shown to the player until 3 seconds are left in the procedure of determining the winners.

For counting the round results, only the selections of players sitting at the same table (as shown by the table number) will be counted. At one table, the player can select only one picture. If the player has several tickers of the same game mode, they will all be distributed to different tables and, if such a distribution is impossible, will be cancelled.

Once a table has been formed, a player can see the table of players he/she is playing with. Depending on the strategy, the player can use information about the rivals countries, level, their number, and consider previous player behavior that the player remembers from the previous games.

The minimum number of players to form a table:

For Type I games - 3; for Type II games - 5; for Type III games - 7. If the number of participants is smaller during the table formation, the player is notified that the table is not formed, and the amount of mana/energy spent to participate in the game is returned to the player. 

Mana/energy distribution in case of victory

The winners take mana/energy from each of the losers. The amount of mana/energy is equal to the game’s option number (1, 5, 10, 50, or 250) and distributed amongst the winners.

If several pictures on the same table received the minimum number of players' votes, then those players become the winners and the mana taken from the players who lost is shared amongst the winners (the players who voted for the pictures that won).

In the event that the game did not take place due to the lack of the minimum number of players required to form a table, and if all pictures got the equal number of players' votes, then the players neither lose nor receive any mana/energy.

Tickers and AutoPlay

When AutoPlay  is enabled, the picture in the chosen game mode will be selected automatically and randomly. At the beginning of each new round, the picture will be selected again until the player has enough resources to play in this mode.

The player can create multiple tickers  when playing in the same game mode. This can be done by pressing the “+” button after any of the pictures have already been selected by the player. The player's selection on the new ticker is the same as the selection made on the ticker when the “+” button was pressed. By switching between tickers, the player can change his/her choice and specifically set it for each particular case.

The player can cancel his/her selection and remove the ticker by pressing the “X”  or “-” button.  The “X” button removes the active ticker, while the “-” button removes the most recently created ticker. The “XX”  button can be used to remove all tickers at once. 

Breaking News & Top Strategists

The tables at which the players managed to win with the highest coefficients are displayed in the “Breaking News” line.

The “Top Strategists” line displays the players with the highest number of consecutive wins (throughout the course of the current day).

Profile

In their personal account  , a player can set up their account settings, enable/disable two-factor authentication, view statistics, game history, transaction history, and send gifts to other players. 

Two-factor authentication allows you to significantly enhance the security of your account. Despite the fact that two-factor authentication is not mandatory, the administrator strongly recommends players enable it. Additionally, without two-factor authentication, a player will not be able to send gifts to other players. 

An additional two-factor authentication code is sent in the following cases:

  • Log in to account (you can disable this feature with no need to disable the 2FA function entirely)

  • Changes to customer information (i.e. email, password)

  • Transfer of resources to another player (this function is available only if 2FA is enabled)


Minority Grail

Minority Grail is the highest game level and can be arranged only with mana. Mana is transferred to the Grail Prize Fund in the event that some pictures were not selected by any of the players, while all other pictures were selected by more than one player.

The Grail game is arranged for each of the 15 game modes and the prize fund of each game is formed by the mana given by the players in the games of this mode.

The player who has fulfilled certain conditions for a particular mode can participate in the Grail drawing.

For example: the next Grail drawing will be held in two days. If a player plays 150 games in I-1 mode (two pictures, 1 mana), then that player will get the right (ticket) to participate in the Grail drawing in I-1 mode. If the player once again meets this condition by the start of the game, he/she will receive another ticket. The number of possible tickets for one player in the same Grail game mode is limited to 50.

Any Grail game ticket is valid only for the next Grail game.

The Grail ticket enables the player to choose any number from 1 to 100 . If there are several tickets, each of them remains independent and the player can choose either the same or different numbers.

All numbers (from 1 to 100) that have been selected by at least one player will be taken into account during the Grail drawing. These numbers form a table, and the number that was chosen by the smallest number of players is declared the winning number. If there were several such numbers, then they are all considered the winning number and the entire Grail prize fund is divided amongst the players who have selected those numbers. The player can no longer change his/her choice after selecting a number.

If the player fulfills the participation conditions for the Grail drawing in any mode, the Player has the right to participate (receives a ticket) in all the drawings of the lower type and option. For example: if participation in the Grail drawing for Type II requires 50 mana, the player can participate in the raffle of the following drawing of the Grail option (II-50, II-10, II-5, II-1, I-50, I-10, I-5, and I-1). Similarly, having fulfilled the conditions for Grail III-250, the player is permitted to participate in all other Grail modes.

If the player, after having received a ticket, does not make any choice, the ticket expires after the Grail drawing.

A ticket to the Grail drawing can also be obtained without meeting the minimum requirements to receiving it as a bonus; it can be drawn by the players/community members.


Augur Series

Two Augur Series tournaments are held on game day (according to server time): Augur Series DayC:\Users\stani\Desktop\Скриншот 05-02-2020 133028.jpg (13:00) and Augur Series Night  (20:00). The tournaments take around two hours. The time and duration of the tournament may vary. It is not necessary to register at the tournament; the player who has a ticket at the moment of registration to the tournament will automatically become a participant.

Sale and the issuance of tickets for the Augur Series, as well as the possibility to transfer the tickets to other players, ends some time before the tournament starts, when registration closed.

You must have a ticket to this tournament (marked with the corresponding signs) to participate in the Augur C:\Users\stani\Desktop\Скриншот 05-02-2020 133028.jpg Series.

The ticket can be either purchased for the amount of mana specified in the tournament information (or on the market) or received as a bonus.

The prize fund of the tournament can be formed not only from mana received from the sale of tickets, but also supplemented with various bonuses.

A tournament table is formed from the players willing to participating in it.

The number of prize-winning places and the accompanying prizes depend on the number of tournament participants.

Tournaments may have restrictions for both the participants (their level, minimum and maximum number of participants, etc.) and for the games (for example: only Type II and III games, specific game options, etc.).

The key conditions of the tournament are as follows:

  • During the tournament, the player continues to play in normal mode with random players (not necessarily with other participants of the tournament); however, all games of the player in which he/she participates and which comply with the tournament conditions will be considered when the tournament table is drawn up. 

  • After each win in such games, the player’s win ratio is recorded in the rating table and summed up with the previous ratios. As a result, the higher the sum of the winning ratios (“Total X” column), the higher the player’s place in the ranking table.

  • Only the games in which mana was selected as a resource are taken into account

  • Loss does not affect the sum of the ratios

  • The game option does not affect the rating (only the final ratio does)

  • In case of the draw between several players, there is the following criteria priority which determines the winner: “TOTAL X” – Won/Games ratio – “Mana Earned”

Intelligence

During the course of playing the Minority, the player gains the experience, which is called Intelligence, thereby increasing his/her level in the game. There are 10 levels depending on the amount of gained experience

The color of the player's nickname also changes once the player achieves a new level, as shown in the table above.

The player's level affects both the quantity and quality of bonuses; the player of a higher level has a higher chance of gaining more mana/energy, as well as more valuable statistics, and other in-game features, such as bonuses. Since the number of bonus Augur Series tickets and Mantles is limited, they are distributed randomly between all active players.

The first 20 players who have reached the Mentalist level receive a lifelong  “Pro”   status, which increases the probability of receiving valuable bonuses by an additional 10%.

Intelligence points are given for participating in the game, as well as for execution of the other game and non-game actions.

Statistics

Throughout the course of the game, the player has the opportunity to receive some information about the current distribution of votes of the other players at specific points in time. This resource can be widely applied to various strategies, as it significantly influences the decision-making process of the players. 

Statistics (S)  is a game resource that allows players to see which one of the pictures, not counting the picture that the player himself chose, has received the minority of votes.

  • For example: 18 people chose between four pictures, and the distribution at the time the statistics appears is as follows: 3, 4, 5, 6. Then, the players who selected the first picture will see how many percent chose the second picture (since 4 is the smallest number among 4, 5, 6); those who chose the second picture will show how many percent chose the first picture (since 3 is the smallest number among 3, 5 and 6). Those who chose the third and fourth pictures will also be shown how many percent chose the first picture. **

** In case there are several such “Minority pictures”, one of them to show is chosen randomly. 

  • Statistics (S) shows the distribution of votes of only those players who sit at the same table with him/her. It can be used both for games in mana and energy resource modes. It is displayed within two seconds, from the 35th to the 37th second of the game. It shows the statistics at the moment of appearance (35th second). This Statistics is available only for certain types of tables. In addition, for each table type, only the statistics for this particular table type can be used. For example, S-4-10 statistics can only be used for games with four images and 10 mana/energy units. To use statistics, the player should: 

  1. Have statistics for this particular game mode

  2. Enable  the use of Statistics in the game by clicking on the corresponding button before tables are formed. 

The statistics will not be displayed at the above-mentioned time if these conditions are not met.

The player can get the statistics of different types as a bonus, purchase it at the marketplace, win it in tournaments, or receive it as a gift. The statistics received as a bonus are valid within 24 hours from the time of receipt, whereupon the bonus expires afterward. In addition, bonus statistics cannot be transferred to another player.

Bonuses

  1. This game features a sophisticated bonus system. The bonuses include a bonus for the daily first login, unique daily bonuses, holiday bonuses, bonuses for achieving various target actions, and more. The bonuses may include the following game features:
    • Statistics

    • Mana/Energy

    • Mantle of Intelligence

    • Mantle of the Deal Maker

    • Ticket to the Augur Series

    • Ticket to the Minority Grail

  2. Mantle of Intelligence allows the player to gain intelligence during the game at an increased rate (for example, with “X2” mantle, the player receives a double the amount of intelligence for the same action). It is valid for 24 hours from time of receipt. To take the advantage of this mantle, the player must first put it on by clicking on the corresponding icon. If the player receives additional Mantles of Intelligence (for example, as a bonus), each new Mantle of Intelligence Player put on, will replace the mantle that Player was previously wearing.

    Mantle of the Dealmaker заменитьenables the player to make any purchases in the game (except Mana, Specials and Tickets to the Augur Series) at a discount during the bonus duration. It is valid for 24 hours after the time of receipt. It cannot be transferred to another player. If the player receives additional Mantle of the Dealmaker (for example, as a bonus), each new Mantle of Dealmaker Player put on, will replace the mantle that Player was previously wearing.

    Ticket to the Augur Series confirms the player's right to participate in the Augur Series. A player can have only a single ticket for the same tournament. If the player receives additional tickets (for example, as a bonus) these tickets will be combined into one.

    Ticket to the Minority Grail   allows the player to participate in the Grail drawing without fulfilling the conditions for achieving the right to participate in it. It cannot be transferred to another player.

    Gift sending

    The player has the ability to transfer certain resources to other players. 

    For security reasons, the gifts can only be sent by those players who have enabled two-factor authentication for their accounts. Two-factor authentication does not affect the ability to receive gifts, however.

    The players can send the following items:

    • Mana (at least 5 units)

    • Statistics (except for statistics received as a bonus)

    • Mantle of Intelligence (if it was not wearing)

    • An Augur Series ticket (if the registration has not yet closed)

  3. The transferred items can be used by the receiving player immediately; there is no suspension period. However, a fee at the rate of 40% of the transferred mana is charged for the transfer of mana between players.

    Daily Missions

    For every new day (according to server time), the player receives a list of missions which will give the player pre-defined bonuses should they be fulfilled. The player has until the end of the day on which the missions were formed to successfully complete the mission (according to server time). If the player completes only a portion of these missions, the player will not receive the final bonuses.


Guild

Players can communicate in an open chat room, which can be accessed using the “Guild” button.

The following actions are strictly forbidden in the Guild:

  • Direct or indirect insults toward other chat participants

  • Using obscene language (even in a distorted form)

  • Discussing or addressing the issues of politics, race, religion, Nazism, suicide, as well as any illegal activity

  • Flooding, flaming, spamming, trolling, and  misusing caps lock

  • Promoting any websites, services, or products

  • Discussing the actions of chat moderators and administrators

  • Begging and seeking additional privileges from the administration

  • Taking any actions aimed at disrupting the chat and server operation

  • Publishing private correspondence between the player and the administrator

If a user violates any of the above-mentioned rules, his/her message can be deleted and the user may be blocked for any term considered reasonable by the administrator or moderator.

The player can contact the administrator using a special chat window. With this window, the player can asks questions, report an error or problem, or complain about actions of the chat moderators.

Terms and Conditions Binding

The Terms and Conditions and all other obligations and rules detailed in writing in Minority (collectively, the "Terms and Conditions") are by and between INTELLECTUAL GAMES OÜ, registration code 14753507, ("Minority," "INTELLECTUAL GAMES OÜ", “Services”, “Company”, "us," or "we") and everyone who uses Minority (each, "you," "user," or "player"). By using Minority, creating an account, and/or participating in any tournament or service offered on or in Minority, you accept and agree to be bound by all terms, conditions and notices contained or referenced in Minority, including the most current version of the Terms and Conditions. INTELLECTUAL GAMES OÜ may modify the Terms and Conditions at any time. Your continued use of Minority following such modifications signifies your acceptance of those modifications. You are responsible for reviewing the Terms and Conditions periodically in order to stay aware of such modifications.

Geographic Disclaimer. The Minority is administered by the INTELLECTUAL GAMES OÜ from Tallinn, Estonia and is intended for users around the world except specific regions.

Registration and participation in the games is open to all countries except Angola, Benin, Bostwana, Burkina Faso, Burundi, Cameroon, Cape Verde, Central African Republic, Chad, Comoros, Congo, Djibouti, Gabon, Gambia, Ghana, Guinea, Kenya, Liberia, Libya, Malawi, Mali, Mauritania, Mauritius, Morocco, Mozambique, Namibia, Niger, Nigeria, Rwanda, Senegal, Somalia, Sudan, Tanzania, Togo, Uganda, Zambia, Zimbabwe. Participants must be 18 years or older.

Failure of INTELLECTUAL GAMES OÜ to exercise their rights under these Terms and Conditions does not constitute a general waiver of those rights.

This Agreement and any documents referred to herein represent the entire agreement between INTELLECTUAL GAMES OÜ and you and supersede any prior agreement, understanding or arrangement, whether oral or in writing. We each acknowledge that we have not relied on any representation, undertaking or promise given by the other or implied from anything said or written in negotiations between us except as expressly stated in this Agreement.

For information purposes, ease of understanding and ease of access by the Player these Terms and Conditions may be published in several languages. Each and every version will contain the same principles however it is only the English version that shall govern the legal relationship between you and us. Should any form of discrepancy arise between the non-English and the English version of these Terms and Conditions, the English version shall prevail over the non-English version.

Any rights not expressly granted in these Terms and Conditions are reserved.

We reserve the right to request proof of age and identity of a Player, at any time, in order to prevent the access of the Website by minors. 

We reserve the right to seek all remedies available at law and in equity in respect of a breach of these Terms and Conditions.

You are not required to pay any entry fees.

By agreeing to these Terms and Conditions, you agree and declare that you have entered your own correct personal details, and that the source of all funds used on the Website are derived from legal activities and that you will not use the Website for illegal or fraudulent activity, including (and without limitation) money laundering as provided by the governing law that applies to You and/or any INTELLECTUAL GAMES OÜ company.

Severability

If any part of this Agreement is deemed invalid or unenforceable, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that reflects as closely as possible the intent of the original provision and the remainder of this Agreement will continue to full effect.

Changes to Minority and/or Terms and Conditions

INTELLECTUAL GAMES OÜ reserves the rights to change, modify, update, discontinue, remove, revise, delete or otherwise change any portion of Minority or these Terms and Conditions, in whole or in part, at any time without further notice. If you access or use Minority in any way after the Terms and Conditions have been changed, you will be deemed to have read, understood and unconditionally consented to and agreed to such changes. The most current version of these Terms and Conditions will be available on https://minoritywins.com/rules/term and will supersede all previous versions of these Terms and Conditions.

ELIGIBILITY, OBLIGATIONS & PLAYER CONDUCT

Eligibility

To be eligible to register and open an account and/or participate in any tournament offered in Minority, you affirm that you: 

  • that you are of the age of 18 or any such other legal age or age or majority as determined by any laws applicable to you, whichever age is greater ("Legal Age");

  • own the email address submitted on your account registration form; 

  • are physically located in a jurisdiction in which participation in a game you select is unrestricted and not prohibited by law; 

  • at all times abide by the Terms and Conditions. 

  • that you are not conducting criminal or otherwise unlawful or unauthorized activities and/or intending to use your account opened with us in connection with such activities and that you shall not use or allow other persons to use the Website and your account for any criminal or otherwise unlawful activities including, without limitation, money laundering, under any law applicable to you or us;

  • not to use the Services/Website in any way which interferes or may interfere with the availability of the Services/Website to other users nor do anything that degrades or may degrade the operational performance of the Services and Website(s);

  • not to solicit or in any manner seek to obtain any information relating to other users;

You can use the Website solely for your private, non-commercial, personal use only. This does not give you any rights of ownership in the Website.

You agree not to use the Website in any way which is:

  • unlawful;

  • may give rise to civil or criminal liability for INTELLECTUAL GAMES OÜ; or

  • which might bring INTELLECTUAL GAMES OÜ into disrepute.

You shall not treat The Company as a financial institution.

Registration and Opening an account.

We will take reasonable and appropriate measures to ensure that your personal information as disclosed to us shall remain confidential and will be processed in accordance with our Privacy Policy as amended from time to time. We will not report or disclose your personal data except in accordance with our Privacy Policy. By entering any game you give your consent to us to publish your details on our Website in the event that you win any game.

You shall not: (i) select or use as a username a name of another person with the intent to impersonate that person; (ii) use as a username a name subject to any rights of a person other than you without appropriate authorization; or (iii) use, as a username, a name that is otherwise offensive, vulgar or obscene. You are solely responsible for the activity that occurs on your Account, and for keeping your Account password and login credentials secure. You may never use another person’s user Account or registration information for the without permission. You must notify us immediately of any change in your eligibility to use the Services (including any changes to or revocation of any licenses from state authorities), breach of security or unauthorized use of your Account. You should never publish, distribute or post login information for your Account. 

You may log in to use the Services by using your Facebook account. By using your Facebook account to log in to the Services, you affirmatively consent to our sharing of your actions and data with Facebook. You must have a valid, active Facebook account to use and access the Services.

You may need to update third-party software, such as your operating system, from time to time to access the Services. We are not responsible in any way for such third-party software. You are responsible for the device you use to access the Services and the fees to connect to the Internet and application marketplaces or for data or cellular usage to download and use the Services.

The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. We do not knowingly collect or solicit personally identifiable information from children under 13; if you are a child under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn we have collected personal information from a child under 13, we will delete that information as quickly as possible. If you believe that a child under 13 may have provided us personal information, please contact us at admin@minoritywins.com.

Location of Users
You are subject to all laws of the city, state, province and country in which you reside and from which you access Minority. You are solely responsible for complying with those laws. Access to Minority may not be legal for some or all residents in certain jurisdictions. You agree that INTELLECTUAL GAMES OÜ cannot be held liable if laws applicable to you restrict or prohibit your use of or participation with Minority. INTELLECTUAL GAMES OÜ makes no representations or warranties, express or implied, as to the lawfulness of your accessing Minority or participating in any tournament offered in Minority. No person affiliated, or claiming affiliation, with Minority has authority to make any such representations or warranties.

INTELLECTUAL GAMES OÜ reserves the right (but has no obligation to you) to monitor the location from which you access Minority and to block access from any jurisdiction in which participation or access may be illegal or restricted. INTELLECTUAL GAMES OÜ may block access to players using proxy servers or any other method which is intentionally used in order to conceal a player's true location. INTELLECTUAL GAMES OÜ may further block players if you are in a jurisdiction where INTELLECTUAL GAMES OÜ is unable to accurately verify your location. We may require any participant receiving any prize to provide us with proof that you are, or at the time the subject tournament was played, eligible to participate according to the Terms and Conditions. If we monitor your access or participation with Minority, we shall not be liable for the effectiveness of such monitoring. By accessing, using, downloading in any way any materials in Minority browsing Minority, creating an account and/or participating in any tournament or service offered by or through Minority, you represent and warrant that you are doing so in compliance with the Terms and Conditions and agree to indemnify and hold harmless INTELLECTUAL GAMES OÜ from any liability, claims, and damages (including attorneys' fees) arising out of or related to your violation of these Terms and Conditions.

If you open an account and/or participate in any tournament offered in Minority while located in a prohibited jurisdiction, you may be in violation of the law of such jurisdiction and will be in violation of the Terms and Conditions and subject to having your account suspended or terminated. In addition, and without limiting any rights or remedies available to Us, in the event of any violation of the Terms and Conditions, all winnings, Game resources may be voided, and in the event such winnings have already been received by you, recouped by Us, at our sole and absolute discretion.

Recommended Devices, System Requirements and Configuration

You understand that by participating in games or any tournaments in Minority, you may be playing against other players using different types of devices. INTELLECTUAL GAMES OÜ shall not be liable for damage that occurs or issues you may encounter if your device does not meet the minimum system requirements or as a result of playing against user of different types of devices.

INTELLECTUAL GAMES OÜ shall not be held liable for damage that occurs or issues that are encountered if your device does not meet the minimum system requirements.

You accept that you are solely responsible for the supply and maintenance of all of the computer equipment and telecommunications networks and internet access services that you need to use in order to access minoritywins.com (“Website”). We will not be liable in any way whatsoever for any loss caused to you by the internet or any telecommunication service provider which you have engaged in order to access to the Services or to the Website.

You accept that if your browser loses connection with our servers at any point during the game you will be eliminated from the game as soon as new round starts.  This might include, but not be limited to, loss of internet connection, changing the page on the browser and closing the browser window or tab.

Acknowledgment of Proprietary Rights
By registering for an account and/or participating in any tournament offered on Minority, you acknowledge that all information contained in Minority may be protected by one or more valid copyrights, patents, trademarks, trade secrets, or other proprietary rights, and that all such rights are owned by INTELLECTUAL GAMES OÜ. INTELLECTUAL GAMES OÜ neither warrants nor represents that your use of materials displayed in Minority will not infringe rights of third parties. INTELLECTUAL GAMES OÜ assumes no liability or responsibility for any errors or omissions in the content of Minority.

Any communication or material you transmit to INTELLECTUAL GAMES OÜ by electronic mail or otherwise, including any data, questions, comments, suggestions, etc. will be treated as, non-confidential and non-proprietary. Anything you transmit or post may be used by INTELLECTUAL GAMES OÜ or its affiliates for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast, Minority promotion, marketing and posting. INTELLECTUAL GAMES OÜ is free to use any ideas, concepts, know-how or techniques contained in any communication you send to INTELLECTUAL GAMES OÜ for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information, without any additional compensation or other liability or obligation to you.

The trademarks, logos, and service marks (collectively the "Trademarks") displayed in Minority, are registered and unregistered Trademarks of INTELLECTUAL GAMES OÜ's and/or others. Nothing contained in Minority should be construed as granting any license or right to use any Trademark displayed on the Site without the written permission of INTELLECTUAL GAMES OÜ or such third party that owns the Trademark. Your misuse of any Trademark displayed in Minority, except as provided in the Terms and Conditions, is strictly prohibited.

Except for these terms and conditions, you may not in any way or by any means adapt, copy, modify, reproduce, store, distribute, display, publicly perform, publish, transmit, sell, rent, lease or license without our express prior written consent.

User Content. All Content added, created, uploaded, submitted, distributed, or posted to the Services by users (collectively "User Content"), whether publicly posted or privately transmitted, is the sole responsibility of the person who originated such User Content. 

License Grant. By submitting User Content through the Services, you hereby do and shall grant us a worldwide, non-exclusive, perpetual, royalty-free, fully paid, sublicensable and transferable license to use, edit, modify, manipulate, truncate, aggregate, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User Content in connection with the App, the Services and our (and our successors’ and assigns’) businesses, including without limitation for promoting and redistributing part or all of the App or the Services (and derivative works thereof) in any media formats and through any media channels (including, without limitation, third party websites and feeds), and including after your termination of your Account or the Services. For the sake of clarity, to the extent any User Content you submit includes your name, likeness, voice, video, or photograph, you acknowledge and agree that the foregoing license shall apply to the same. Winner photographs may be used in promotional activities such as print and online advertising campaigns.

You also hereby do and shall grant each user of the App and/or the Services a non-exclusive, perpetual license to access your User Content through the App and/or the Services, and to use, edit, modify, reproduce, distribute, prepare derivative works of, display and perform such User Content, including after your termination of your Account or the Services. For clarity, the foregoing license granted to us and our users does not affect your other ownership or license rights in your User Content, including the right to grant additional licenses to your User Content, unless otherwise agreed in writing. You represent and warrant that you have all rights to grant such licenses to us without infringement or violation of any third party rights, including without limitation, any privacy rights, publicity rights, copyrights, trademarks, contract rights, or any other intellectual property or proprietary rights.

All third party trade names and trademarks are the property of their respective owners and we make no warranty or representation in relation to them.

You acknowledge that we are not responsible for any User Content posted in connection any portion of the Services.

If you are aware of any User Content posted in connection with the Services that violates these Terms of Use, please contact us at LEGAL@MINORITYWINS.COM. Please provide as much detail as possible, including a copy of the underlying material, the location where we may find it, and the reason such User Content should be removed. Please note that filing a complaint will not guarantee its removal. We only will remove User Content if we believe the measure is necessary, in our sole discretion.

Promotional Activities
By registering for an account, you agree that INTELLECTUAL GAMES OÜ may display your username and tournament records. By accepting any prize from INTELLECTUAL GAMES OÜ, you agree to allow INTELLECTUAL GAMES OÜ to print, publish, broadcast and use, worldwide, in any media and at any time, your name, picture, voice, likeness, and/or biographical information for promotional, marketing or related purposes without additional compensation.

ACCOUNT MANAGEMENT

Limitations on Number of Accounts

You may establish only one account per person to participate in the activities offered on Minority. Multiple accounts may not be created sharing the same name or email. INTELLECTUAL GAMES OÜ reserves the right to monitor all activities on Minority, including any effort to establish multiple accounts. In the event INTELLECTUAL GAMES OÜ discovers that you have violated the number of accounts allowed, all additional accounts will be closed without notice and continued violation may result in the termination of any and all of your accounts and INTELLECTUAL GAMES OÜ may void any associated winnings, Game Resources of any or all of the account(s). INTELLECTUAL GAMES OÜ further reserves the right to deny access to anyone, including, but not limited to, those players who use proxy servers and/or IP addresses residing in certain geographical areas. Your account may be blocked in case of logging in Account into multiple devices simultaneously.

Credit Card Transactions, Game Resources and Deposit Resources

You agree that we or a payment processing company on our behalf will handle all financial account transactions ("Payment Processor"). You hereby agree that the Payment Processor reserves the right to withhold any payments should the Payment Processor have reason to believe or any suspicion that you may be engaging in or have engaged in fraudulent, collusion, unlawful, or improper activity.

INTELLECTUAL GAMES OÜ reserves the right to set expiration dates or other limits on all Game Resources. Game Resources are defined as any credit to play a game deposited by INTELLECTUAL GAMES OÜ into an account, including, but not limited to, promotional Resources, prize Resources and gift Resources. Deposit Resources are defined as any credit to play a game deposited into an account for making a purchase in store located at https://minoritywins.com/shop/. INTELLECTUAL GAMES OÜ may void the Game Resources balances of any dormant account. A dormant account is an account that has been inactive for greater than four (4) months.

Once payment towards the Minority has been submitted, the payment may not be cancelled, revoked or changed.

You are fully responsible for paying all monies owed to us. In respect of any payment made by you, you agree that you will not make or procure the making of any charge-backs and/or deny or reverse any such payment, and that you will reimburse us for any charge-backs, denials or reversal of payments you make, and any and all losses suffered and expenses incurred by us as a consequence. We may, at our sole and absolute discretion, cease to provide services or payment to certain users or to users paying with certain credit or debit cards.

If You have a query with regard to any transaction, You may also contact Us with details of the query. We will review any queried or disputed transactions. Our judgment is final.

Fraud and Abuse

Fraud and abuse relating to the access and use of Minority is strictly prohibited. In accessing Minority or participating in any activities, products or services offered by or through Minority, you represent and warrant that: (a) all information you supply is complete and accurate and not in violation of any applicable laws, regulations or these Terms and Conditions; and (b) you will not circumvent or attempt to circumvent any provision of the Terms and Conditions or engage in any activity that interrupts or attempts to interrupt the operation of Minority. Users engaging, participating or displaying behavior that may be interpreted, in INTELLECTUAL GAMES OÜ's sole and absolute discretion, as the use of unfair methods in Minority, including but not limited to:

(i) the opening and/or use of multiple accounts;

(ii) the use of unauthorized or altered software or hardware to assist play (including the use of bots, bot nets, jail broken devices or rooted devices, collusion with bots and/or use of cheat programs such as debuggers, clock-skewing software and memory scanners);

(iv) collusion with other players;

(vi) harassment of other participants;

(vii) posting of objectionable material;

(viii) any breach of the Terms and Conditions;

(ix) any breach of the security of your account or Minority; or

(x) any other act (whether through the use of automated technology or otherwise) that unfairly alters your chance of winning or constitutes the commission of fraud (collectively, "Abuse")

Engaging in any of the above or any similar behavior, while playing Minority, may subject you to immediate consequences (as determined by INTELLECTUAL GAMES OÜ in its sole and absolute discretion), including without limitation: (1) immediate termination of your account and blocking of Minority access; (2) forfeiture of any prizes, winnings, Game Resources and any other item of value (if any) that you may otherwise have been entitled to receive; (3) disgorgement and/or recoupment of any prizes, winnings, Game Resources and other items of value already received by you; and (4) in the case suspected illegal activity, disclosure to law enforcement agencies in accordance with federal and state laws. In the investigation of an alleged Abuse, INTELLECTUAL GAMES OÜ may request additional information from you. You agree to provide all reasonable and relevant information as requested by INTELLECTUAL GAMES OÜ. Without limiting any provision of the Terms and Conditions, INTELLECTUAL GAMES OÜ expressly reserves the right to institute or seek any injunctive relief, civil and/or criminal proceedings against you and/or any of your co-conspirators arising out of or related to your commission of Abuse, including the right to recover fees and expenses (including attorneys' fees) and the right to report you and such Abuse to any and all relevant regulatory authorities or governmental agencies.

INTELLECTUAL GAMES OÜ does not warrant that user submitted content is verifiable, nor does INTELLECTUAL GAMES OÜ warrant that user submitted details such as age, location etc are truthful. INTELLECTUAL GAMES OÜ is not responsible for any interaction between players on the site.

In compliance with applicable laws, court orders and lawful government and regulatory requests we may be required to access and disclose individually identifiable information on registered members.

You are not permitted to translate, reverse engineer, decompile, disassemble, modify, create derivative works based on, or otherwise modify the quiz application software.

You are not permitted to bypass the security system or interfere in any way with the Services or the Website or attempt to make any changes to the Software and/or any features or components.



Withdrawal Requests

Game Resources have no cash value and cannot be withdrawn. User's failing to comply with an investigation of or Users found to have engaged in Abuse, may have their winnings voided.

If your account is closed by INTELLECTUAL GAMES OÜ for a violation of the Terms and Conditions, your winnings and any Game Resources may be voided and not returned to you. 

Account Cancellation

You may cancel your account by contacting INTELLECTUAL GAMES OÜ at admin@minoritywins.com

Your account is not considered cancelled until you have received confirmation of such cancellation from INTELLECTUAL GAMES OÜ. You may not cancel your account to evade an investigation. If you do not agree to the terms of the INTELLECTUAL GAMES OÜ Policies, your sole remedy is to not use Minority and to cancel your account.

Upon the termination of this Agreement for whatever reason, the License issued under this Agreement is automatically revoked and you shall stop using the quiz application/services.

Should this not be possible, then the remaining balance in that Account will be removed at the end of this further period of 1 year in total from becoming Dormant and the Account closed.

TOURNAMENTS

Game Rules
Rules for each specific game offered in Minority can be found within the Tutorial and Game Rules for each game.

We reserve the right at any time to cancel, modify or replace the prize draw (including varying the prizes) if, at our sole discretion, a prize draw is not capable of being conducted as specified.

You acknowledge that in the unlikely event of a disagreement between any result that appears on the Website and our server, the result that appears on the server will prevail and you acknowledge and agree that our records will be the final authority in determining the terms and circumstances of your participation in the gaming activity.

If you have any dispute with regard to the result or of any game, play or event with regards but not limited to: the result, rulings and treatment applied by us, technical or other disruption, etc, you must submit your written complaint to us, via email, within fourteen (14) days from the date of the result of any game or event.

In the event of any dispute regarding winnings, our decision will be final and binding. 

Unless otherwise stated, in case of conflict between these Terms and Conditions and any other document referred to in these Terms and Conditions, these Terms and Conditions will prevail;

It is strictly prohibited to:

  • Exploit or distribute any game error or technical glitch that provides an unintended advantage to a user, including but not limited to accessing one time promotions more than once;

  • Fraudulently acquire Virtual Currency or Virtual Goods;

  • Rent, lease, sell, trade, or otherwise transfer or share your account to or with anyone without INTELLECTUAL GAMES OÜ 's written permission;

  • Access or use an account which has been rented, leased, sold, traded, or otherwise transferred from the account creator without INTELLECTUAL GAMES OÜ written permission;

You shall immediately inform the Company of the error and shall repay any winnings credited to Your Player Account in error to The Company (as directed by The Company) or The Company may, at its discretion, deduct an amount equal to those winnings from Your Player Account.

If prior to The Company becoming aware of the error You have played with funds that do not belong to You, without prejudice to other remedies and actions that may be available at law, the mistakenly paid winnings will be deducted. In the event of an incorrect crediting, You are obliged to notify The Company immediately by email admin@minoritywins.com.

We reserve the right to offer, from time to time, bonuses and/or promotions and special offers and that any such offer will be subject to its own rules and conditions. We reserve the right to withdraw any of these special offers and bonuses at any time.

LIMITATION OF LIABILITY

Unauthorized Charges

INTELLECTUAL GAMES OÜ is not liable for any loss caused by any unauthorized use of your credit card or other method of payment by a third party in connection with Minority. If you wish to dispute a charge to your account, you must do so within 14 days of the alleged unauthorized charge(s) otherwise such a dispute will be deemed waived by INTELLECTUAL GAMES OÜ. Upon notification of a disputed charge, INTELLECTUAL GAMES OÜ may conduct an investigation to determine the amount, if any, considered unauthorized.

Attempts to defraud INTELLECTUAL GAMES OÜ through the use of credit cards or other methods of payment, or your failure to honor legitimate charges or requests for payments may result in immediate termination of your account, forfeiture of prizes and/or civil and/or criminal prosecution.

Hacking, Tampering, or Unauthorized Access
IN NO EVENT SHALL WE, NOR OUR DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO THE SERVICES FOR ANY injuries, death, loss, tax liability or damage of any kind ,LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, COMPENSATORY OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER (HOWEVER ARISING), FOR ANY BUGS, VIRUSES, TROJAN HORSES.

By using the Minority, each Player further agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with Player’s use the Minority game resources earned or Prizes awarded, shall be resolved individually without resort to any form of class action.

You are responsible for the security of your account. If you give someone access to your account and they conduct a transaction without your knowledge or permission, you are responsible for any resulting use. Such transaction is not considered to be unauthorized by INTELLECTUAL GAMES OÜ.

Any attempt to gain unauthorized access to INTELLECTUAL GAMES OÜ's systems or any account, interfere with procedures or performance of Minority, or deliberately causing damage to or undermining Minority, may subject you to civil and/or criminal prosecution and may result in immediate termination of your account and forfeiture of any prizes.

You shall not: (i) take any action that imposes or may impose (as determined by us in our sole discretion) an unreasonable or disproportionately large load on our (or our third party providers’) infrastructure; (ii) interfere or attempt to interfere with the proper working of the Services or any activities conducted on the Services; (iii) bypass, circumvent or attempt to bypass or circumvent any measures we may use to prevent or restrict access to the Services (or other accounts, computer systems or networks connected to the Services); (iv) run any form of auto-responder or "spam" on the Services; (v) use manual or automated software, devices, or other processes to “crawl” or “spider” any page of the Minority without our express written permission; (vi) harvest or scrape any Content from the Services; or (vii) otherwise take any action in violation of our guidelines and policies.

You will not create or provide any means (including, without limitation, via emulators) through which the Software may be used by others.

In the event of systems or communications errors relating to account settlement or any other elements of the Service, we will not be liable to you as a result of any such errors and we reserve the right to void all plays affected by such error, interference or damage and take any action to correct such errors, damage to your own computer system, any other Device(s) or data contained within.

We, our affiliates, partners, officers, employees and agents shall in no event be responsible or liable for any damages, loss or expense, including without limitation direct, indirect, consequential or special damage or economic loss arising from or in connection with your access or use of the Services, Website(s), Software and the Information.

Accounts for Individual Use Only
You are solely responsible for all obligations relating to your account and for compliance with these Terms and Conditions. You are entitled to all benefits accruing to you as a result of being the account holder. You may not allow any other person to access your account, access Minority, accept any winnings, or participate in any Tournament using your account. Your account is not transferable. By registering and/or participating in any Tournament offered in Minority, you agree to indemnify, defend, and hold INTELLECTUAL GAMES OÜ harmless from or for any claims, liability, damages, and/or costs (including attorneys' fees) arising from any use of your account by any person.

Minority and Account Availability

INTELLECTUAL GAMES OÜ does not guarantee that Minority or access to your account will be available at all times and/or in all geographic locations. INTELLECTUAL GAMES OÜ is not liable for any loss which may be caused by your inability to access Minority or your account.

We will not be liable for any loss to you or a third party as a result of:

  • any failure on our part to interact with you where we may have concerns about your activities;

IN NO EVENT SHALL ANY OF THE PROTECTED PARTIES BE LIABLE TO ANY PLAYER FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE ARISING FROM ANY USE OF THIS APP OR THE CONTENT EVEN IF THE PROTECTED PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME STATES DO NOT ALLOW THE EXCLUSION OF DAMAGES OR LIMITATION OF LIABILITY AS SET FORTH ABOVE, SO THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU. MERCHANDISE PRIZES

General Disclaimer
Terms and Conditions for tournaments with merchandise prizes are the same as those for ordinary games (for mana or energy as Virtual Currency).

Substitution
Players may request from INTELLECTUAL GAMES OÜ an offer of cash payment in lieu of any prize won, although INTELLECTUAL GAMES OÜ is under no obligation to grant such request. If INTELLECTUAL GAMES OÜ elects, in its sole discretion, to offer a cash payment in lieu of any prize won, INTELLECTUAL GAMES OÜ reserves the right to determine the exact amount of the cash offer, even if such cash offer may be less than the value of the prize. The player may then elect to accept INTELLECTUAL GAMES OÜ's cash offer, accept the original prize, or decline both and take nothing. INTELLECTUAL GAMES OÜ also reserves the right to credit the account of a merchandise prize winner with mana (the amount of which is in INTELLECTUAL GAMES OÜ's sole discretion) in the event the prize remains unclaimed for a certain period of time which shall in no event be less than thirty (30) days

Ties
In the event of a tie in a merchandise prize Augur Series, the player who posted the tying score first will be considered to have finished ahead of the other tying player(s). For example, if user X and user Y tie for 1st place with a score of 1500, and user X finished his/her game at 2:00pm, and user Y finished his/her game at 3:00pm, user X would win the 1st place prize, and user Y would win the 2nd place prize (if any).

Taxes
As with our Augur Series, users are responsible for applicable income taxes for merchandise prizes. Either the Manufacturer's Suggested Retail Price, or INTELLECTUAL GAMES OÜ's acquisition price, at INTELLECTUAL GAMES OÜ's discretion, will be used as the cash value of the merchandise prize.

Warranties
In the case of merchandise covered by a manufacturer's warranty, the manufacturer and not INTELLECTUAL GAMES OÜ is responsible for initial defects, subsequent use or misuse or covered repairs. In the case of merchandise not covered by a manufacturer's warranty, the merchandise is offered "as is", and INTELLECTUAL GAMES OÜ is not responsible for any defects, use or misuse or repairs. INTELLECTUAL GAMES OÜ makes no representations or warranties with respect to the authenticity or genuineness of any merchandise prizes, particularly collectible prizes.

Disputes with Others
Minority reserves the right, but has no obligation, to monitor and/or manage disputes between you and other users of the Services. If you have a dispute with other users, you release and hereby agree to indemnify Minority from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such dispute.

Force Majeure

Player complaints are taken seriously at Minority.

If you have a complaint or are experiencing difficulty with the Services you can raise your complaint with the Customer Support team either via email customer@minoritywins.com or Chat with Administration.

Any complaint or claims of any nature, including with regard to the Player Account (gameplay, transactions or other matters) or Player Account balance, should be communicated to us as soon as possible by contacting our Customer Support team and no later than 14 days after the issue has occurred.

Virtual Currency
